Why pouches and snus are not the same case
Almost every English-language page on this subject collapses two different products into one verdict. It is worth taking them apart, because the difference is the whole answer.

It bans the import of tobacco products consumed by being heated or lit, other than a listed set of conventional products, and of all products used to imitate tobacco products regardless of their nicotine content, including electronic cigarettes and electronic hookahs together with the devices, apparatus, spare parts and solutions used to consume them.
Every category the decree names is either heated, lit, or a piece of hardware. A tobacco-free pouch is none of those things. It is not burned, not vapourised, not a device, and it contains no tobacco to be imitated in the sense the decree is describing. The reading that sweeps pouches into 2149 has to stretch the phrase about imitation a long way past the company it keeps in the text.
The draft law gives the game away
If you want one piece of evidence that current Turkish law does not cover tobacco-free pouches, it is the bill that would change that. The sweeping tobacco and nicotine draft now in public discussion does not simply extend penalties. It rewrites the definition of a tobacco product to include any product containing natural or synthetic nicotine, whether or not it contains tobacco. Lawmakers do not redraft a definition to capture something the old definition already caught. The proposal is an admission that the pouch currently sits outside.
Turkish-language coverage lands in the same place, describing tobacco-free pouches as absent from pharmacies and supermarkets but not named in any ban. The trackers that report pouches as banned in Turkey, and some reputable ones do, cite each other rather than a Turkish instrument. There is no underlying rule to cite, which is why none of them cite one, and we would rather tell you that than repeat the shorthand.
