2. Eligibility

You must be at least 18 years old to use this website and purchase products. By placing an order, you confirm that you are 18 years of age or older. We reserve the right to request age verification at any time, including upon delivery.
2.2 Consumer Purchases
Our website is intended for consumers making purchases for personal use. For business enquiries (B2B), please contact us at contact@pouchspot.com.
2.3 Geographic Restrictions
We only ship to countries listed on our website. It is your responsibility to ensure that nicotine pouches can be legally imported and possessed in your country, region, or state. We cannot be held responsible for orders seized by customs or local authorities.
3. Products
3.1 Product Information
We make every effort to display product information accurately, including descriptions, ingredients, nicotine content, and imagery. However, we do not warrant that product descriptions or other content are error-free or complete.
3.2 Health Disclaimer
Nicotine pouches contain nicotine, which is an addictive substance. Our products are intended for adult nicotine users only. They are not suitable for non-nicotine users, pregnant or breastfeeding women, or persons with cardiovascular conditions.

All orders are subject to product availability. We reserve the right to discontinue products at any time. If a product you ordered is unavailable, we will notify you and offer a refund or alternative.
4. Orders
4.1 Order Confirmation
When you place an order, you will receive an automatic acknowledgement email. This does not constitute acceptance of your order. A binding contract is only formed when we send you a dispatch confirmation email.
4.2 Right to Refuse Orders
We reserve the right to refuse or cancel any order for any reason, including but not limited to:
- Suspected fraudulent activity
- Inability to verify age
- Product unavailability
- Errors in pricing or product information
- Orders to countries we do not serve
If we cancel your order after payment has been taken, we will issue a full refund.
4.3 Order Accuracy
You are responsible for ensuring that all information provided when placing an order is accurate and complete, including delivery address and contact details. We cannot be held responsible for failed deliveries due to incorrect information.
5. Prices and Payment
5.1 Pricing
All prices displayed on our website are in Euros (EUR) and include applicable VAT. Prices are subject to change without notice, but changes will not affect orders for which we have already sent a dispatch confirmation.

In the event of a pricing error, we will contact you before processing your order. You may choose to proceed at the correct price or cancel for a full refund.
6. Shipping and Delivery
6.1 Shipping Regions
We currently ship to Germany and select EU countries. A full list of countries we ship to is available on our Shipping page. We do not ship to France, Belgium, the Netherlands, or Finland due to local regulations.
6.2 Shipping Costs
Shipping costs, if any, are displayed at checkout before you complete your order. Free shipping is available on qualifying orders as indicated on our website.
6.3 Dispatch and Delivery
Orders are dispatched from Sweden via DHL. Estimated delivery times are:
- Germany: 2-4 business days
- Other EU countries: 3-6 business days
These are estimates only and not guaranteed delivery times. We are not responsible for delays caused by carriers, customs, or other factors beyond our control.
6.4 Delivery Confirmation
Delivery is confirmed when the package is delivered to the address provided or collected from a pickup point. Risk of loss passes to you upon delivery.
6.5 Failed Deliveries
If a delivery fails due to your absence and the package is returned to us, we may charge you for redelivery or deduct return shipping costs from your refund.
6.6 Uncollected Packages
If you fail to collect a package from a pickup point within the carrier's specified timeframe and it is returned to us, we reserve the right to charge you for outbound and return shipping costs.
7. Right of Withdrawal
7.1 Withdrawal Period
If you are a consumer in the EU, you have the right to withdraw from your purchase within 14 days of receiving your order, without giving any reason.
7.2 How to Withdraw
To exercise your right of withdrawal, contact us at contact@pouchspot.com with your order number and a clear statement of your decision to withdraw. You may use the following template:
"I hereby give notice that I withdraw from my contract of sale for the following goods: [product name/order number], ordered on [date], received on [date]. Consumer name and address."
7.3 Conditions for Returns
Due to hygiene regulations, we can only accept returns of:
- Unopened products in original, sealed packaging
- Products in resaleable condition
We cannot accept returns of opened cans or products that have been used, damaged, or tampered with.
7.4 Return Shipping
You are responsible for the cost of returning products to us unless the products are defective or we sent the wrong items.
7.5 Refunds
Once we receive and inspect your return, we will notify you of approval or rejection. Approved refunds are processed within 7 business days to your original payment method.
7.6 Exclusions
The right of withdrawal does not apply to business customers (B2B).
8. Defective or Incorrect Products
8.1 Damaged Shipments
If your order arrives damaged, please contact us within 2 business days of delivery with photos of the damage. We will arrange a replacement or refund.
8.2 Concealed Damage
For damage not visible upon delivery, please report it within 7 business days of receipt.
8.3 Incorrect Items
If you receive the wrong product, contact us immediately. We will arrange for the correct item to be sent and provide a prepaid return label for the incorrect product.
8.4 Failure to Report
If you do not report damage or incorrect items within the timeframes specified above, we may not be able to offer compensation.
10. Limitation of Liability

To the fullest extent permitted by law, our total liability to you for any claim arising from or related to these Terms or your use of our website or products shall not exceed the amount you paid for the relevant order.

These Terms are governed by the laws of Estonia, without regard to its conflict of law provisions.

13.3 Jurisdiction
Any disputes that cannot be resolved amicably shall be submitted to the courts of Estonia.

We reserve the right to modify these Terms at any time. Changes become effective when posted on our website. Your continued use of the website after changes are posted constitutes acceptance of the revised Terms.
